Terms of Service

Colour Outside, LLC — Ministry Sites
Effective Date: September 1, 2026

These Terms of Service (“Terms”) govern your purchase and use of a website subscription through Ministry Sites (ministrysites.colouroutside.com), a product of Colour Outside, LLC (“Colour Outside,” “we,” “us,” or “our”), a company based in Williamsburg, VA. By submitting the onboarding form, approving your project brief, or making payment, you (“Client,” “you”) agree to these Terms.

If you do not agree to these Terms, do not submit payment.

1. The Service

Colour Outside will design, build, host, and maintain a custom website for you based on the information, goals, and preferences you provide during onboarding (“the Site”). The Service includes:

A custom-designed, mobile-responsive website built on the pages and features you select during onboarding
Website hosting
A standard domain connection or new domain registration (see Section 6)
Routine maintenance, security updates, and platform upkeep for as long as your subscription is active
Reasonable support from our team

The Service does not include, unless separately purchased or quoted: logo/brand identity design, professional copywriting, stock photography licensing, e-commerce payment processing setup, third-party software subscriptions (e.g., giving platforms, scheduling tools), or marketing/advertising services. These are available as optional add-ons and will be quoted and agreed to separately before any additional charge.

2. Pricing & Payment

There is one plan: a one-time setup fee plus a recurring monthly fee, as quoted to you in your project brief before checkout (currently $499 one-time + $79/month).

The one-time setup fee and your first month’s subscription fee are due at signup.
Your monthly fee will be charged automatically on the same day each month to the payment method on file, using our payment processor (Stripe), until you cancel.
There is no minimum commitment or contract length. You may cancel at any time (see Section 4).
If a monthly payment fails, we will attempt to notify you and may retry the charge. We reserve the right to pause work or take your Site offline if payment is not resolved within a reasonable time.
Prices may change for future billing periods with at least 30 days’ notice to the email on file. Changes will not apply retroactively.

3. Project Process, Revisions & Your Responsibilities

We aim to launch your Site within a reasonable timeframe based on the scope you select and how quickly you provide content and approvals.

Revisions: We include a reasonable number of revision rounds during the initial build so you’re happy with the result before launch. Requests for a substantially new design direction, or revisions requested after launch, may be quoted as additional work.
Content & responsiveness: You are responsible for providing text, photos, logos, and other materials we don’t source for you, and for reviewing and approving pages in a timely manner. If we do not hear from you for an extended period (45+ days) with no content or approvals provided, we may pause active build work until you’re ready to continue; your subscription will continue to be billed as normal, since it also covers hosting and maintenance of whatever is live at that time.
Your content: You represent that you own or have the rights to any text, images, audio (e.g., sermon recordings), logos, or other materials you provide us, and you agree to reimburse us for any claims, damages, or costs arising from content you provided that infringes someone else’s rights (for example, an unlicensed stock photo or copyrighted music).

4. Cancellation

You may cancel your subscription at any time, for any reason, with no minimum commitment. To cancel, contact us at admin@colouroutside.com.

When you cancel, your Site will remain live and hosted through the end of the current paid month.
At the end of that month, your Site will be taken down and your subscription will end. No further charges will be made.

5. Refunds

One-time setup fee: Refundable in full if you cancel within 3 days of your initial signup/payment. After that 3-day window, the setup fee is non-refundable, regardless of how much build work has been completed.
Monthly fees: Monthly subscription charges are non-refundable, including partial months. Since there’s no minimum commitment, you’re only ever charged for time already used or the month already in progress.

6. What Happens After Cancellation — Site Files & Domain

Site files: After your Site comes down at the end of your final paid month, you have 90 days to request a transfer. If you provide the necessary access to a new host of your choosing within that window, we will transfer your website files for a one-time fee of $500. After 90 days, your website files will be permanently deleted and cannot be recovered.

Domain:

If we registered or are managing your domain and you cancel, we will not renew it upon expiration.
If you want to keep the domain, you must provide the access we need to transfer it to a registrar of your choice before it expires. We will complete a domain transfer for a one-time fee of $150.
If the domain expires before a transfer is requested, it will become available for anyone to re-register, and you would need to register it again yourself (subject to availability) if you still want it.

We are not responsible for domains that expire or become unavailable due to a transfer not being requested in time.

7. Ownership

Your brand and content: You retain all ownership of your business/organization name, logo, trademarks, and any content you provide us (photos, text, sermon media, etc.).
The Site itself: While your subscription is active, your Site is built, hosted, and maintained on Colour Outside’s platform and infrastructure. It is not automatically portable to another host. If you’d like a copy of your Site to use independently — whether while still subscribed or after cancellation — we can provide a full transfer/migration for the fee described in Section 6.
Our work product: Design elements, custom code, and templates we develop as part of our platform (as opposed to your specific content) remain the intellectual property of Colour Outside, LLC, except as included in a transferred copy of your Site under Section 6.

8. Disclaimers & Limitation of Liability

The Service is provided “as is.” We do not guarantee specific business outcomes (e.g., search rankings, donation totals, lead volume, attendance) resulting from your Site. To the fullest extent permitted by law, Colour Outside’s total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost revenue or donations.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you by email before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in James City County, Virginia.
